1. Introduction
Thank you for using Vintokyo. By downloading, installing, accessing, or using the Vintokyo mobile application and related services provided by emonster, inc. (collectively, the "Services"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Services.
2. About Vintokyo
Vintokyo is an iPhone shopping guide for Tokyo vintage, secondhand, resale, and curated retail discovery. The Services may include curated shop data, neighborhood routes, editorial notes, map pins, saved and visited lists, image delivery, offline-first content, price context, JPY currency conversion, and a price-tag scanner.
Vintokyo is not a generic map service, store inventory system, authentication service, personal shopper, marketplace, payment service, tax advisor, or travel agency.
3. License and Permitted Use
Subject to your compliance with these Terms, emonster grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the App for your personal, non-commercial use on an iPhone that you own or control.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or attempt to derive source code from the App except to the extent expressly permitted by applicable law.
4. Eligibility
You must be at least thirteen (13) years old, or the minimum age required in your jurisdiction, whichever is greater, to use the Services. If you are under the age of majority where you live, you may use the Services only with consent and supervision of a parent or legal guardian.
5. Curated Guide Content
Vintokyo content is curated for discovery and decision support. Store inventory, prices, opening hours, addresses, route suggestions, tax-free availability, payment methods, language support, and accessibility information may change without notice and may be inaccurate, incomplete, delayed, or unavailable.
You are responsible for confirming all practical information directly with a store, venue, payment provider, map provider, or other relevant party before traveling, purchasing, or relying on it.
6. Authentication, Inventory, and Transactions
Vintokyo does not authenticate goods, guarantee inventory, verify item condition, represent listed shops, broker purchases, process payments to shops, guarantee tax-free eligibility, or resolve disputes with stores or sellers. Any purchase or interaction with a store is solely between you and that store or seller.
7. Maps, Directions, and Location
The Services may show map pins, launch external map apps, show local Apple Weather conditions, and optionally use your location to show your position on the map, show live weather, or suggest scanner source settings. Map, weather, and directions data are provided by Apple, Google, or other third-party services and may be inaccurate or unavailable. Always use your own judgment and comply with local rules and conditions.
8. Price Tags, OCR, and Currency Conversion
The scanner may use your camera or selected photos to detect visible price tags, product names, price-label terms, and approximate currency conversions. OCR, translation, and parsing results may be incomplete, delayed, inaccurate, unavailable, or misinterpreted.
Currency conversions are approximate. Rates may be delayed, cached, unavailable, rounded, or different from rates used by card issuers, banks, payment processors, stores, or currency exchange providers. Vintokyo may obtain exchange-rate data from Frankfurter or another configured provider. We do not control third-party exchange-rate providers and do not guarantee rate accuracy, availability, timeliness, or completeness.
9. Paid Access and StoreKit
Vintokyo may offer non-renewing passes and a lifetime unlock through Apple's StoreKit. Final prices, taxes, availability, refunds, offer codes, and billing are handled by Apple and may vary by storefront. Non-renewing passes provide access for the stated duration from purchase date and do not automatically renew.
10. Offline and Cached Data
The App is designed to launch with bundled content and may cache content updates, saved shops, visited shops, preferences, and exchange-rate snapshots locally. Cached content may become outdated. You remain responsible for deciding whether cached or approximate information is acceptable for your use.
11. Privacy
Your use of the Services is also governed by our Privacy Policy. Vintokyo is designed to process camera frames and selected photos on device for scanner features. The Services may use Firebase Analytics, Mixpanel, Firebase Crashlytics, Firebase Remote Config, Firebase Storage, StoreKit, Apple MapKit, Apple WeatherKit, Mapbox Maps, and exchange-rate providers as described in the Privacy Policy.
12. No Emergency, Safety, or Professional Use
Vintokyo is a convenience and discovery tool. It is not designed for emergency, safety-critical, regulated, professional, authentication, appraisal, tax, legal, financial, or high-stakes use. Do not rely on the Services where inaccurate guide data, OCR, translation, location, or currency conversion could cause significant harm.
13. Prohibited Uses
You agree that you will not:
- Use the Services for any illegal purpose or in violation of applicable law;
- Interfere with, disrupt, or attempt to compromise the Services;
- Use the Services to infringe the rights of emonster or any third party;
- Use automated means to access, scrape, copy, or abuse the Services;
- Remove, alter, or obscure copyright, trademark, or proprietary notices;
- Misrepresent Vintokyo content, OCR results, guide notes, or currency conversions as guaranteed, official, or provided by a store, bank, card issuer, government, or authentication service.
14. Intellectual Property
Vintokyo, the Vintokyo application icon, product screenshots, user interface, software, text, graphics, curated data, branding, and related assets are owned by emonster or its licensors and are protected by intellectual-property laws. No rights are granted except as expressly stated in these Terms.
15. Third-Party Services and Content
The Services may use or link to third-party services, content, data, frameworks, or websites, including Apple services, StoreKit, MapKit, Mapbox Maps, Firebase, Nuke, SFSafeSymbols, and exchange-rate providers. Third parties operate independently and may have their own terms and privacy policies. We are not responsible for third-party content, data, availability, policies, or practices.
16. Changes to the Services
We may modify, update, suspend, or discontinue the Services or any part of them at any time, with or without notice. We are not obligated to provide maintenance, support, updates, or continued availability except to the extent required by applicable law.
17. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMONSTER DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMONSTER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, TRAVEL COSTS, PURCHASE DECISIONS, OR OTHER LOSSES ARISING OUT OF OR RELATED TO THE SERVICES. EMONSTER'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO EMONSTER FOR THE SERVICES DURING THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
19. Indemnification
You agree to indemnify, defend, and hold harmless emonster and its affiliates, officers, employees, agents, partners, and licensors from claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services, your violation of these Terms, or your violation of applicable law or third-party rights.
20. Termination
We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive termination will survive.
21. Governing Law and Venue
These Terms and your relationship with emonster are governed by the laws of the State of Washington, U.S.A., without regard to conflict-of-law principles. You agree that legal proceedings relating to these Terms or the Services will be brought exclusively in the state or federal courts located in King County, Washington, unless applicable law requires otherwise.
22. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. These Terms, together with the Privacy Policy, End-User License Agreement, and any applicable App Store terms, form the agreement between you and emonster for the Services.
