THIS END-USER LICENSE AGREEMENT ("AGREEMENT") IS BETWEEN YOU AND EMONSTER, INC. ("EMONSTER") AND GOVERNS YOUR USE OF THE VINTOKYO APPLICATION (THE "SOFTWARE"). BY INSTALLING OR USING THE SOFTWARE, YOU AGREE TO THIS AGREEMENT, TOGETHER WITH EMONSTER'S TERMS OF USE AND PRIVACY POLICY, EACH INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE, DO NOT USE THE SOFTWARE AND UNINSTALL IT FROM ANY DEVICE YOU OWN OR CONTROL.
1. License Grant. Subject to your compliance with this Agreement and the App Store Terms of Service, emonster grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software, in object-code form only, on an iPhone that you own or control, solely for your personal, non-commercial use.
2. Restrictions. Except as expressly permitted by this Agreement or applicable law, you may not: (a) copy, modify, adapt, translate, or create derivative works based on the Software; (b) reverse engineer, decompile, disassemble, or attempt to derive source code or internal structure from the Software; (c) rent, lease, lend, sell, sublicense, distribute, transfer, or make the Software available to a third party; (d) use the Software for a commercial service bureau or hosted service; (e) circumvent, disable, or interfere with security-related features; or (f) use the Software in violation of law or third-party rights.
3. Eligibility. You must be at least thirteen (13) years old, or the minimum age required in your jurisdiction, whichever is greater, to use the Software. If you are under the age of majority, you may use the Software only with consent and supervision of a parent or legal guardian.
4. Ownership. The Software is licensed, not sold. emonster and its licensors own all rights, title, and interest in and to the Software, including copyrights, trademarks, trade secrets, patents, user interface design, icons, graphics, text, curated shop data, route content, and other materials. emonster reserves all rights not expressly granted to you.
5. Vintokyo Content. The Software provides curated Tokyo vintage shopping information, neighborhood notes, shop metadata, map pins, saved and visited lists, guide content, price context, and a price-tag scanning tool. The Software does not authenticate goods, guarantee inventory, represent listed shops, or provide official store information unless an official partnership is explicitly stated.
6. Store and Map Information. Store inventory, prices, opening hours, addresses, tax-free availability, payment methods, language support, map locations, and route suggestions may be inaccurate, incomplete, delayed, or unavailable. You are responsible for confirming information directly with each store or service before traveling, purchasing, or relying on it.
7. Price Tags, OCR, and Currency Conversion. The Software may use your camera or selected photos to detect visible price tags, product names, price-label terms, and approximate currency conversions. OCR results and exchange-rate outputs may be inaccurate, incomplete, delayed, cached, or misinterpreted. Exchange rates may come from Frankfurter or another configured provider and may differ from rates used by banks, card issuers, payment processors, stores, or exchange providers.
8. Paid Access. Vintokyo may offer non-renewing passes and a lifetime unlock through StoreKit. Access terms, prices, taxes, availability, promotional offers, refunds, and billing are handled by Apple and may vary by storefront. Non-renewing passes expire based on purchase date and the pass duration shown in the App or App Store.
9. Privacy. The Software may process camera frames and selected photos on the device, store preferences locally, cache curated content, live weather preferences, and exchange-rate data, and use third-party services including Apple services, Apple WeatherKit, Firebase, Mixpanel, and exchange-rate providers as described in the Privacy Policy. Your use of the Software is also governed by emonster's Privacy Policy.
10. No Professional Advice. The Software does not provide financial, investment, tax, accounting, legal, travel, shopping, authentication, appraisal, or currency-exchange advice. It is a convenience and discovery tool and should not be used as the sole basis for purchases, transactions, travel budgets, tax decisions, or financial decisions.
11. No Warranty. THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMONSTER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS DISCLAIM ALL WARRANTIES, REPRESENTATIONS, GUARANTEES, AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.
12. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMONSTER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, TRAVEL COSTS, PURCHASE DECISIONS, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT. EMONSTER'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THIS AGREEMENT OR THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO EMONSTER FOR THE SOFTWARE DURING THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification. You agree to indemnify, defend, and hold harmless emonster and its affiliates, officers, employees, agents, partners, and licensors from claims, liabilities, damages, losses, costs, and expenses arising out of or related to your use of the Software, your violation of this Agreement, your violation of applicable law, or your violation of third-party rights.
14. Termination. This Agreement is effective when you first install or use the Software and continues until terminated. Your rights under this Agreement terminate automatically if you fail to comply with any term. Upon termination, you must stop using the Software and delete all copies from your devices. Sections that by their nature should survive termination will survive.
15. Third-Party Content and Services. The Software may display, include, or access third-party content, data, services, frameworks, or websites, including Apple services, StoreKit, MapKit, Mapbox Maps, Firebase, Mixpanel, Nuke, SFSafeSymbols, and exchange-rate providers. emonster does not control and is not responsible for third-party content, data, services, availability, terms, or privacy practices.
16. Changes to the Software. emonster may modify, update, suspend, or discontinue the Software or any part of it at any time, with or without notice or liability. emonster is not obligated to provide maintenance, support, updates, or continued availability except to the extent required by applicable law or App Store terms.
17. Apple Terms and Third-Party Beneficiary. This Agreement is between you and emonster, not Apple Inc. ("Apple"). Apple is not responsible for the Software or its content and has no obligation to provide maintenance or support. To the extent any warranty obligation cannot be disclaimed, emonster, not Apple, is responsible. Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
18. Governing Law and Venue. This Agreement and your relationship with emonster are governed by the laws of the State of Washington, U.S.A., without regard to conflict-of-law principles. Legal proceedings relating to this Agreement or the Software will be brought exclusively in the state or federal courts located in King County, Washington, unless applicable law requires otherwise.
19. General. If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in effect. You may not assign this Agreement without our prior written consent. The failure to enforce a provision is not a waiver. This Agreement, together with the Terms of Use, Privacy Policy, and applicable App Store terms, is the agreement between you and emonster for the Software.
